Stream Factory is a cloud-based Software-as-a-Service (SaaS) platform that enables content creators to broadcast pre-recorded video content as live streams to various streaming platforms, including but not limited to YouTube, Twitch, and Facebook ("Platform Services").

1.1 Core Features

Our Service provides:

• Cloud-based video storage and management
• Playlist creation and scheduling capabilities
• 24/7 automated livestream broadcasting
• Multi-platform streaming support
• Stream health monitoring and automatic recovery
• Analytics and usage reporting

1.2 Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable advance notice, and emergency maintenance as needed without notice. Stream Factory shall not be liable for any temporary unavailability of the Service.

1.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including features, pricing tiers, or supported platforms. Material changes will be communicated to users with at least 30 days notice when reasonably possible.

2.1 Eligibility

To use Stream Factory, you must:

• Be at least 16 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Have valid accounts on the streaming platforms you wish to use

When creating an account, you must:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Use a unique password not used on other services
• Notify us immediately of any unauthorized account access

2.3 Account Responsibility

You are responsible for all activities that occur under your account. Stream Factory will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

2.4 One Account Per Person

Each person may only maintain one Stream Factory account. Creating multiple accounts to abuse free trials, circumvent restrictions, or for any fraudulent purpose is strictly prohibited and may result in immediate termination of all accounts.

All payments are processed securely through Stripe, Inc. By subscribing to our Service, you agree to:

We reserve the right to investigate suspected violations of these Terms. We may report illegal activities to law enforcement and cooperate with their investigations. Violations may result in immediate suspension or termination of your account without refund.

When using Stream Factory to broadcast to third-party platforms, you remain solely responsible for compliance with each platform's terms of service and community guidelines.

You represent and warrant that:

• You own or have obtained all necessary rights to stream the content
• Your content does not infringe any third-party intellectual property rights
• You have necessary licenses for any music, images, or third-party content

You are solely responsible for maintaining your accounts on third-party platforms. Stream Factory is not liable for:

• Suspension or termination of your platform accounts
• Copyright strikes or community guideline violations
• Monetization issues or revenue loss
• Changes to platform APIs or policies
• Any actions taken by platforms against your account

5.4 No Circumvention of Platform Rules

You must not use Stream Factory to circumvent, abuse, or violate any platform's terms, policies, or restrictions. This includes but is not limited to:

• Artificially inflating view counts or engagement metrics
• Evading content restrictions or bans
• Streaming content that violates platform monetization policies
• Using the service to spam or flood platforms with content

6.1 Your Content

You retain all ownership rights to the content you upload to Stream Factory ("Your Content"). By uploading content, you grant us a limited, non-exclusive, royalty-free license to:

• Store your content on our servers
• Process and transcode your content for streaming
• Transmit your content to the platforms you specify
• Create thumbnails and previews for your dashboard

This license terminates when you delete your content or close your account.

6.2 Stream Factory's Intellectual Property

The Service, including its original content, features, functionality, branding, and code, is and remains the exclusive property of Stream Factory and its licensors. Our Service is protected by copyright, trademark, and other laws.

6.3 Feedback

If you provide feedback, suggestions, or ideas about our Service, you grant us an unrestricted, perpetual, royalty-free license to use such feedback for any purpose without obligation to you.

6.4 DMCA and Copyright Claims

We respect intellectual property rights and expect our users to do the same. If you believe content on our Service infringes your copyright, please send a DMCA takedown notice to:

Stream Factory is not liable for:

• Loss of revenue, viewers, or subscribers on third-party platforms
• Actions taken by third-party platforms against your account
• Interruption of your streams due to technical issues
• Loss or corruption of your uploaded content
• Third-party claims arising from your content
• Changes to third-party platform APIs or policies
• Force majeure events beyond our reasonable control

10.1 Termination by You

You may cancel your subscription and close your account at any time through your account settings or by contacting support. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• Active streams will continue until your subscription expires
• You can export your content before account closure
• After the billing period ends, your account and content will be deleted

10.2 Termination by Stream Factory

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or our Acceptable Use Policy
• You engage in fraudulent or illegal activities
• You fail to pay subscription fees after the grace period
• Your use poses a security risk to us or other users
• Required by law enforcement or legal process

10.3 Effect of Termination

Upon termination:

• All active streams will be terminated immediately
• Your access to the Service will be revoked
• Your content will be scheduled for deletion within 30 days
• No refunds will be provided for termination due to Terms violations
• Provisions that should survive termination will remain in effect
